I'm not so sure about that. What something like abortion, if the Republicans got their was, there would no longer be federal law and it would go back to a state level. Wade says state laws banning it *** the fouteenth amendment but, if it ever gets overturned, control will go back to the state level and it would be a mess again. It just so happens that insurance law is written almost entirely at the state level with only two exceptions, which is why I used it as an example. Iowa is considered the expert at writing insurance law and is often used as reference by other states when writing insurance law. How much they differ from it or don't use, will determine how well they regulate and control it but, in any case the experience in writing it is at the state level. When the federal government steps in to write insurance law, they're doing it with very little experience. Out of the two laws that have done, the first one COBRA, works well but, was done a long time ago when each state had a lot fewer laws that they had written to consider. HIPAA passed recently, in 1998 and in comparimister is a mess because of lack of experience in writing that type of law along with all the laws that have since been written in each state. My point being here is that, when the federal government steps in now after each state has been writing all the law for so long, it makes much more of a mess (the longer they have, the bigger the mess).
